How to register a property

Once we have acquired a property or property, it is important to register it. Through this process, we legally register all the documents related to this property, either at the acquisition level or all the acts and contracts related to that property, such as mortgages, judicial decisions, servitudes, among others. The registration in the registry of a property can be requested by:

  • Who acquires the property or right
  • Whoever transmits it
  • The person interested in insuring the right to register
  • A legal representative of any of the three persons mentioned above

Before registering the property, the titles of the property must be recorded in a public deed, executed by an authenticated document issued by the judicial authority.

In addition, the payment of all taxes corresponding to the type of act or contract to be registered must be made.

There are five types of entries in the property registry, the one chosen will depend on the type of procedure that is intended to be carried out:

  • Presentation seat: to present documents, it has an expiration date
  • Registration seat: to register and publish in the register facts, acts or rights that will affect the property
  • Preventive annotation: to protect rights that have not yet been made or to publish certain judicial and administrative decisions
  • Marginal note: to record any secondary event that could affect a property
  • Cancellations: to revoke registrations and annotations

To register a property, you must present the original title of the property, along with all relevant documents according to the type of seat you wish to carry out, in the registry corresponding to the province where the property was acquired or they have performed the actions.

Within a period of 15 days, the qualification and registration of the titles presented must be done.
