Unpaid work permits - status of workers

In the workers' statute a series of permits and licenses are collected that allow us to have a few days off from work while we keep our salary intact, like when we got married, or we have a son.

However, sometimes we need a few days pounds and to request them we can not accept any of the assumptions included in the law. In this case, we must request an unpaid permit, in which we will not work but we will not charge those days either.

Unpaid leave in Spain: few days

Legally there are a series of assumptions and conditions according to which we may not attend our job. Normally, these assumptions are due to extraordinary events or situations, for example, the birth of a child, the death of a direct relative or if we get married.

However, sometimes we see an emergency that must be addressed but is not covered by the law, what should be done in this case? Since the workers' statute does not include all the possible circumstances that could merit a work permit, there is the possibility of applying for an unpaid permit, which means that you will not work but you will not be paid while you are not at work.

For this, a letter should be written to the Human Resources Department of the company, however, it is essential that it complies with a series of key points before requesting it:

  • Know the advance with which you would have to request it.
  • Know how many days you can ask each year.
  • Know if you need to have some seniority in the company.
  • Know if it is necessary to spend some time between one permit and another.

All these specifications you will find in the collective agreement of your professional sector and must be taken into account. If you do not do this, you may be denied the request due to a defect in form and may be left without permission.

Extended unpaid leave

If instead of just a few days you want to be absent from work for a long time, you can reach an agreement with the company to suspend your contract during that time. This implies not only the non-receipt of salary, but also the employment contract is suspended. In this case, it is necessary that you make sure you book the job in order to be able to return to it once your permit is finished.

Unpaid leave exceeding 2 years

If your absence is to exceed two years, you can take voluntary leave . However, not everyone can benefit from this situation since to be able to request a voluntary leave it is necessary to have a seniority in the company of at least one year.

Other aspects that you must take into account is that the duration of the leave can not be longer than five years and there is no right to reserve the job.
