How extra hours worked are paid

Sometimes and for reasons of force majeure, the boss may ask an employee to work more hours than those listed in the employment contract. This is known as extra hours . In the following article, we indicate how the overtime worked should be paid .

Steps to follow:

one

The Working Day, according to the Collective Agreement, states that the worker has to do at most 40 hours per week. Therefore, both parties must agree on a working day less than or equal to 40 hours a week.

two

In addition, workers must have a minimum weekly rest of a day and a half without interruption and of 2 days, if they are under 18 years of age. Although there are sectors such as security guards, hoteliers or sea workers who are governed by a specific regulation.

An extra hour, as explained above, is each hour of work that exceeds the maximum duration of a working day set by agreement or in the Workers' Statute. Thus, their remuneration is fixed by agreement of the parties or by collective agreement, but in no case may be lower than what is paid for each hour of ordinary work. Instead of being paid, they can also be exchanged for free days.

Let's see how the extra hours are calculated . A worker has to perform by collective agreement, 1, 680 hours per year. Let's suppose that your workday is of 38 hours distributed from Monday to Friday in 8 hours a day, except on Fridays, which only takes 6 hours. Not counting the holidays, that worker will make 1976 hours, a figure that comes from multiplying the weekly hours 38 x 52, a number that corresponds to the weeks of the year. Taking into account that the year has 14 holidays (14 x 8 daily hours = 112), it would make only 1864 hours per year, since the number of annual hours without holidays (1976) has been subtracted from the number of holiday hours (112) . If even so, we discount the holiday month, that is, the 22 working days that month, you would subtract 176 more hours, a figure that comes from multiplying the holiday working days (22), by the number of hours that He has his working day (8). With what to the year it would realize 1, 688 hours. With which, the worker would only perform 8 extra hours per year, because instead of performing 1680 hours, which is what is fixed by agreement, performs 1688.

The maximum number of extra hours that can be done in Spain is 80 hours per year . And each extra hour performed is paid with 75% of the salary that is received every hour of employment.

To calculate the hourly wage, the gross monthly salary (without extra hours) must be divided among the hours worked per month. That will give what is charged per hour. And to the result you will have to calculate 75%.
