How to stand for an election

To appear as a candidate in an election, a series of requirements must be met, described in article 6 of the Electoral Law . We explain them to you so that you know in which cases you can present yourself and in which others you can not. In addition, it also affects the European level. Every Spanish citizen with the right to vote can compete as a candidate in an election. Citizens whose connection with the Administration may not be able to stand for election are members of the Royal Family, the Ombudsman, the State Attorney General, the president of RTVE and regional radio and television, etc.

Article 7.3 of the Electoral Law establishes that the following professionals can participate in elections: -Magistrados.-Judges and prosecutors.-Professional and complementary military.-Members of the security forces and police bodies.They have to formulate a petition before the higher body of the body for which they work.

Directive 94/80 / EC provides that EU citizens residing in a Community country other than their own may stand as candidates for municipal elections in the locality in which they reside. On the other hand, to exercise the right to passive suffrage facing the European Parliament will have to meet the following requirements: -To have the status of EU citizen. -To be eligible to stand as a candidate in the country of origin.

The candidacy for an election must be formalized before the Electoral Board presenting a letter containing the name and acronyms of the party, federation, coalition or group to which it belongs. If the application is made up of lists, the names of all the people who attend them must be included.

Those sentenced by a final sentence to a penalty of deprivation of liberty may not stand as candidates for an election for the duration of the sentence. Neither may people who have been convicted of crimes of rebellion or terrorism against the Public Administration or against State Institutions. Their sentences must disqualify them from exercising the right to passive suffrage.

Citizens who: - Occupy the most relevant positions of each ministry in the different territorial demarcations of less than the state level. - Carry out the functions of president, director or assimilated positions of autonomous entities may not stand as candidates for regional or municipal elections. whose competence is limited to the scope of the autonomous community itself. - They have been appointed territorial delegates of RTVE or directors of a regional radio or television. - They are presidents or directors of the peripheral organs of the managing entities of the Social Security. - They are secretaries generals of the delegations and sub-delegations of the Government or provincial delegates of the Electoral Census office.

An application will cease to be valid from the moment a final judgment declares it illegal, for whatever reason. Neither the candidacy of any person or organization linked in any way to the outlawed will be accepted.
