What to do if I'm self-employed and I'm out of work

Unsubscribing as a self-employed person is a sometimes difficult decision, but sometimes it is more appropriate to minimize losses if you are going through a difficult time, without clients or without a sufficient workload, waiting to resume activity at another time . Therefore we give you some indications on what to do if you are autonomous and you are out of work

Steps to follow:

The first thing you must do if you are self-employed and you run out of work is to request the withdrawal in the Tax on Economic Activities (IAE), presenting in the Tax Agency the declaration model 036. You can do it in person at any office of the Agency or through Internet, in its Electronic Headquarters.

You must unsubscribe as a self-employed person, filling in the TA.5021 form in any office of the General Treasury of the Social Security or in its Administration, for which there is a period of 6 calendar days from the cessation of the activity. The withdrawal will take effect from the first day of the month in which all the necessary conditions to be processed are met.

Once discharged from the self-employed regime, and the corresponding tax obligations ceased, you must go to the Employment Service of the Autonomous Community to register as unemployed, and thus be able to apply for job offers and training courses.

If the necessary requirements are met, you can choose to collect the corresponding unemployment benefits . For this, professional contingencies must be covered, the payment of Social Security obligations must be up to date and a minimum contribution period must be maintained for the cessation of activity for 12 months, continuing immediately before the cessation. The month in which the cessation of activity occurs also computes in this case. On the other hand, the cessation of activity must occur due to force majeure and duly accredited.

At the time when the activity is resumed, you must unsubscribe as unemployed and re-register in the IAE and the RETA again, just as you did the first time. The most advisable thing is to do it at the beginning of the month, since when you register you must enter the corresponding Social Security fee, even if you are on the last day of that month.
