What to do if I run over a boar

The trampling of wild boar unfortunately is common on roads in rural areas or near hunting grounds. These wild animals can become very large and commonly cause serious accidents with major damage to vehicles, caused not only by the boar's winding but also by swerves, invasions from the other lane and collisions that may occur as a result. The first thing you should do if you run over a boar - or more than one, because it is common to see them in a herd - will try to stay calm and warn the traffic authorities of your autonomous community. In this way, the Police can attest to the accident and the animal causing the accident.

In case the wild boar is dead or has not been able to get very far away, it will be fundamental not to touch it or move it so that the police authority can specify in the report how the animal has been run over and where it came from. Similarly, it is advisable to take photos - with the mobile phone for example - so that there is graphic evidence of what happened.

At the time of removing the body of the animal from the road, the same traffic authorities will be responsible for doing so or, if still injured but alive, forest agents should take care of taking it to a wildlife recovery center.

As to who will be responsible and will be responsible for the damage caused by the boar, in Spain it is necessary to refer to the provision "Liability in traffic accidents for violations of game species" of Law 17/2005, of July 19 .

In this way, several situations are contemplated in which the person in charge can be:

  • "The owner of the Public Road or the licensee in charge of its maintenance, when the accident is due to the lack of conservation of the road." You can only claim the State or the concessionaire company if a lack of signage or fencing is demonstrated.

It is important to note that most insurance policies of the vehicle do not directly take responsibility for this type of damage caused by wild boar, unless there is a clause that specifies it in a specific way. The insurance company may try to claim responsibility to the hunting ground or the owner of the road if possible, but you should always check first what is the coverage you had contracted.

The procedure to be followed to claim those responsible will be to file a civil claim for Civil Liability through an ordinary or verbal civil procedure, based on the amount to be claimed for the damages caused by the boar.
