How holidays are paid

Holidays have always been a workhorse between workers and entrepreneurs. Article 40.2 of the Spanish Constitution requires employers to grant paid holidays to their employees, as it is an inalienable right of every worker. In the following article, .com tells you how vacations are paid.

Steps to follow:

The minimum duration of the holidays is stipulated by the type of contract you have. Thus, the worker will be entitled to a minimum of 30 days of vacation per year worked. In the case of part-time contracts, vacations are calculated according to the days worked. For each month worked correspond 2 and a half days of vacation. That is, if 12 months are worked, we would have to multiply 12 * 2.5.

In every company, the worker must be informed of the holiday calendar with at least 2 months in advance of their enjoyment.

Once the holiday calendar has been approved, no changes can be made to the dates, unless these changes are for exceptional and very serious reasons.

During the holidays, what is known as the principle of equivalence is applied, that is, the worker must receive the same salary that would have corresponded to him if he had gone to work. Even so, there are items that do not have to be included during the holidays, such as the payment of premiums, overtime and supplements paid depending on the work performed.

On the other hand, people who are on vacation may work during their rest period in another company, not being able to do it once they have rejoined their current job.

The company may request the incorporation of the worker during the holidays due to exceptional circumstances, although there is a legal vacuum in this regard and the worker will not be required to go to his job.
