How a discontinuous fixed contract works

Spain is a country where we can find an immense variety of different work contracts, specifically more than 40 different ones. In recent years, reforms have been carried out in the labor market to simplify the types of contracts and improve the flexibility of workers and employers, but the most important ones will continue to be valid. One of them is the discontinuous fixed contract, whose operation we will explain in this article of .com

What is a discontinuous fixed contract

The discontinued fixed contract means that a company and a worker have an agreed contract, in which the worker performs his work at certain times of the year in which extra reinforcement or a certain number of workers are necessary, for several years or seasons.

For example, it could be valid for those people who have a contract with a hotel on the beach, and in the intense summer season they work in this hotel for several consecutive seasons, under the stipulations of the contract.

The contract itself must stipulate on what dates and according to what workload the presence of the hired worker will be necessary, as well as the collective agreement that will be applicable and the manner in which the worker will be notified to join a new season.

Characteristics of discontinuous fixed contracts

The main characteristics that make up this type of contracts are the following:

  • The regulation of the regular part-time contract is applied.
  • The contract is indefinite throughout the seasons.
  • This type of contract, during the work season, can be full-time or part-time as determined.
  • If there is a lot of uncertainty about the work season and the applicable schedule (depending on the demand for work) it will be stated in the contract that this is the case, and indicative dates and times will be stipulated.
  • The salary will be proportional to the hours of work.
