It is important to know, in the first place, the requirements that both parties must meet in order to register as a de facto couple. These are:

  • Joint coexistence in the last 12 or 24 months, depending on which autonomous community.
  • Be of age.
  • Be willing to be a de facto couple, that is, single, separated, divorced or widowed.
  • Not have a kinship bond
  • Not be registered as a de facto partner of another person.

The members of the couple will be able to obtain 15 days of permission to register as a de facto couple - as in a marriage - in the case that this is provided by the collective agreement of the work they develop or of which they are officials.

The widow's or widower's pension may be obtained in case of death of any of the members, provided that minimum requirements are met, which are:

  • Coexistence for at least the last 5 years before the death, demonstrable with the municipal census.
  • Have registered as a domestic partner at least two years before the death.

In the event that the member of the couple who owns the rental of the domicile of coexistence dies, the Urban Leasing Law allows the subrogation of the couple, provided that at least two years of cohabitation at said domicile are accredited.

Subsidies for maternity or paternity are provided in full right to be exercised by both partners, as in marriage.
