What is eviction express

Eviction express is established for the case of rents. In November 2009 came into force with the aim of promoting housing for rent in Spain, a country where it represents a very small percentage, compared to some European countries. Many owners prefer to have their homes empty before renting, for fear of not charging. Thus, the figure of the express eviction is created, to give guarantees to the landlord, with which the procedures have been streamlined to forcibly evict the delinquent tenant.

Steps to follow:

Trying to avoid unnecessary delays, the process of eviction can be initiated by setting the amount claimed in the lawsuit. In the case of claiming only the eviction, the amount of the demand will be equivalent to one annuity of rent and if one wants to evict more claim of rents, the amount will be the one of the due rents.

Prepare the documentation to begin the eviction . With the demand you have to provide a series of documents. First the lease and the document that certifies the lack of payment. It is also convenient for the express eviction to present the authentic requirement of payment. The Law establishes the impossibility of opposition of the lessee. Thus, after the request to the tenant, the Judicial Secretary will dictate a Decree by which the eviction will be agreed.

As for the requirement and summons to practice the tenant, it will be that of the place established in the lease contract as address for notifications.

The Law provides for the possibility of the owner forgiving all or part of the debt. This option would be conditioned to the tenant evicting the house and / or premises in the term established by the landlord in the application.
