According to the type of dismissal

If it turns out that our employment relationship with the company has ended by means of a dismissal, the corresponding compensation will vary according to the circumstances and the type of dismissal. They can be classified as follows:

  • You are: we will generally be entitled to compensation of 20 days per year worked.
  • Resignation of the worker: will not be entitled to compensation.
  • Proper dismissal: occurs when the competent authority approves the motivating reasons for the dismissal, such as if the worker does not adapt to the company, or if it is a disciplinary dismissal, by failing to comply with its obligations or unjustifiably absent from work. In these cases, the compensation will depend on the reason for the dismissal, although the maximum will be 20 days / year.
  • Unfair dismissal: when it occurs due to the decision of the company to do without that worker, without apparent reasons and even when it fulfills its obligation. The compensation will be 45 days / year for the time quoted until February 2012, and 33 days / year for the time quoted after this date. According to the type of contract

In many cases, the right to compensation also varies according to the type of contract we have with the company, and in the form in which it ends:

  • Indefinite or temporary contracts that terminate unfairly before time, will be entitled to compensation of 45 days / year until February 2012 and 33 days / year in the quotes after this date.
  • The contracts for the promotion of employment have a compensation of 33 days / year.
  • Temporary contracts have an amount of compensation that would be 8 days / year worked.
