How to change the order of surnames

Nowadays it is more frequent and easy to make a change of surnames . It is no longer mandatory for the child to have the father's first name and then the mother's surname. Generally, the newborn is given two surnames, the first one that coincides with the first one that the father has, and the second one that is the first of those held by the mother.

However, the parents of the newborn have the possibility of altering this order and imposing as the first surname of the mother, provided that the following circumstances are met: - That they so decide in agreement. - That the order (first the father and second of the mother or vice versa) is chosen at the time of registration of the birth of the child in the Civil Registry.

If there is no such agreement, or is not explicitly chosen for it, the father's first name will appear as the first surname of the child. It is important to emphasize that the order chosen for the firstborn will determine the order that will be imposed on his brothers, that is, the chosen order can not be altered when the birth of a second child is registered.

There are special cases in which one of the parents may not be known. In these cases, the newborn will carry the two surnames of his father or mother and the parent who registers it will be able to choose the order in which he wishes these to appear.

The change in the order of the surnames is requested by completing an official form at the moment in which the birth registration is going to proceed, or through an application to the Civil Registry once the interested party reaches the age of majority. This request will be resolved by the General Directorate of Public Registries and Notaries, which reports to the Ministry of Justice.
